Doesn't the county have a lawyer on retainer all the time to take care of any kind of legal stuff like this and thus really wouldn't cost any more than what they already pay. The only extra expense could be court costs which would all be put on SP as the foreseeable loser.

That should be correct. The SB should have one on retainer. In Scott County the current super is also the lawyer on retainer. Of course sinced he is stepping down as super only 6 months in, one of them he says is health issues, he isn't giving up the lawyer gig....
